A Third Party Intervention in the case Cassar v Malta has been filed jointly by TGEU, INTERIGHTS and The International Commission of Jurists – ICJ on 31 July 2012.
The case concerns the refusal of Maltese authorities to recognize a trans woman as female upon legal gender recognition and as a result refuse her right to get married.
The intervention seeks to inform the court about trends in case law in defining sex within legal gender recognition case law, with a focus on the right to self-determination and the separation from medical requirements.
